2. Subject

These Terms and Conditions of Sale govern access to and use of the PlayQR services, an online platform accessible via playqr.ch and its mobile app. Placing an order implies full and unconditional acceptance of these terms and conditions. The customer acknowledges having read these Terms and Conditions of Sale prior to placing any order.

3. Nature of Service

PlayQR is a suite of SaaS (Software as a Service) solutions comprising several modules:

  • PlayQR – QR Dynamiques : Generation and management of dynamic QR codes (URLs, text, images, PDFs, videos, vCards, Wi-Fi, .ics events) with scheduling and scan statistics.
  • PlayQR – Business Cards Creation and management of dynamic QR business cards for teams and companies, with a centralized dashboard and CSV import/export.
  • PlayQR – Showcase : mobile mini-site for merchants (if applicable, depending on the activated module).
  • PlayQR – Reviews Customer review management funnel (if applicable, depending on activated module).

All services include an online dashboard. The QR Dynamiques and Business Cards modules also come with an iOS and Android mobile app.

The service is hosted in Switzerland with Infomaniak Network SA.

4. Subscription Length

Subscriptions are annual (12-month commitment). They are not automatically renewed. Upon expiration: the customer may choose to renew. Otherwise, related services (QR codes, business cards, etc.) will be deactivated. Data is retained for two (2) months after the expiration date. After this period, it is permanently deleted. During these two months, the customer may reactivate their subscription.

5. Service Activation

The service is activated only after payment has been received. If an invoice remains unpaid, neither QR code nor the business card will be activated. Upon renewal, a 30-day grace period is granted before deactivation.

6. Free trial period

When creating an account and after email verification, the user can benefit from a free trial period of fourteen (14) calendar days.

Start of the trial: The activation date and time of the trial on the user account (customer portal).

Perimeter During the trial, PlayQR provides access to a limited set of features depending on the module being tested (for example, 1 dynamic QR code for the QR module, 5 cards for the Business Cards module). Details regarding the trial scope are specified on the Pricing page for each module.

At the end of the 14 days: no automatic billing is performed. The customer must subscribe to a paid subscription to continue using the service. Otherwise, access will be suspended.

7. Refund Policy

Any order for a paid subscription is firm and final. No refunds will not be granted: in case of non-use, in case of customer error, in case of early termination, in case of violation of the T&Cs. The customer acknowledges having a prior 14-day free trial period to verify the suitability of the service for their needs before any purchase. Detailed terms for billing, upgrades, downgrades, and add-ons are specified in the Billing Policy.

8. Upgrade / Downgrade

8.1 Definition of the Contractual Month

The contractual month is calculated from date to date, starting from the initial service activation date. Each monthly period begins on the activation date and ends on the day before the same numerical day of the following calendar month; or, when the following calendar month does not have that numerical day, on the last calendar day of that month. Only fully completed contractual months are considered earned.

8.2 Upgrade — possible at any time. The initial annual deadline is maintained. Months elapsed remain acquired. The amount billed corresponds to the difference between the plans, calculated on the remaining months until the deadline.

8.3 Downgrade — possible only at the annual expiration date. No partial refunds are granted during the year.

9. Forbidden use

It is strictly prohibited to use PlayQR for: illegal content, hateful or discriminatory content, pornographic or sexually explicit content, phishing, downloading malware, redirecting to malicious websites, or violent or terrorist content.

Any violation will result in: immediate suspension without notice, account deletion, reporting to the authorities if necessary, and no compensation. The customer is solely responsible for the content to which their QR codes and business cards redirect. PlayQR reserves the right to suspend or delete any account in the event of reasonable suspicion of unlawful use.

10. Responsibility

The service is provided on a "best effort" basis. No absolute guarantee of 24/7 availability is provided. Maintenance may be performed: up to twice a year, preferably at night, for a maximum duration of one hour. PlayQR’s total liability, for any cause whatsoever, is strictly limited to the amount actually paid by the customer for the current contract year. Under no circumstances shall PlayQR be held liable for indirect damages, business losses, or loss of revenue.

11. Personal Data

PlayQR collects only the data strictly necessary for the performance of the contract (last name, first name, address, email address, and technical data related to the account and scans). The data is hosted in Switzerland. Details regarding data processing, retention periods, and user rights can be found in the Privacy Policy.

12. Business References

Unless written objection to play-qr@pqr.ch, PlayQR may cite the customer as a reference and use its logo for non-commercial promotional purposes.

13. Force majeure

PlayQR shall not be held liable in the event of a cyberattack, major system failure, natural disaster, government decision, or any other event of force majeure.

14. Partial Invalidity

If any clause of these terms and conditions is found to be invalid, the remaining clauses will remain in full force and effect.

15. Modification of the Terms and Conditions

PlayQR may amend these Terms and Conditions at any time. The applicable version is the one in effect at the time of the order. Customers will be notified of any substantial changes via email.

16. Chargeback clause

Any improper attempt to initiate a chargeback (reversal of payment with the bank) without first contacting PlayQR to seek an amicable resolution may result in legal action and claims for damages.

17. Penalty clause

In the event of fraudulent or harmful use of the service, PlayQR may seek full compensation for any damages incurred, without prejudice to any potential criminal prosecution.

18. Technical Abuse - Anti-bot / Mass Scan

It is strictly prohibited to use the PlayQR service in an automated or abusive manner, including through scripts, bots, mass scanning, scraping, intentional overloading, or attempts to circumvent technical limitations. PlayQR reserves the right, in the event of suspicious activity or proven abuse: temporarily limit traffic, block IP addresses or requests, suspend or terminate the account with immediate effect, without compensation, and without prejudice to any action seeking compensation for damages incurred.
